4. ORDERING PROCESS

4.1 Quotations and Orders

  • All prices quoted are estimates and subject to final measurement and specification confirmation
  • Orders are only confirmed upon receipt of an approved Purchase Order or payment of an invoice
  • Design approval may result in specification changes and price adjustments

4.2 Order Acceptance

  • We reserve the right to accept or decline any order at our discretion
  • Order confirmation will be provided in writing within 3 business days of order placement
  • Changes to confirmed orders may incur additional charges and extended delivery times

5. PRICING AND PAYMENT

6. MANUFACTURING AND DELIVERY

  • Standard manufacturing timeframe: 2-6 weeks from order confirmation and design approval
  • Custom or complex orders may require extended timeframes
  • Timeframes are estimates and may be affected by material availability, weather, or other factors beyond our control

6.2 Delivery

  • Delivery dates are estimates and not guaranteed
  • Customer must provide safe and accessible delivery location
  • Additional charges apply for crane access, special delivery requirements, or remote locations
  • Risk passes to customer upon delivery to nominated address

7. INSTALLATION SERVICES

7.1 Installation (Where Applicable)

  • Installation services are performed by our sister company, Express Glass 24 Hour Service Pty Ltd, and are subject to the Express Glass 24 Hour Service Pty Ltd Terms and Conditions

8. WARRANTIES

8.1 Product Warranty

  • Alspec Carinya products carry manufacturer's warranty as provided by Alspec
  • Warranty covers manufacturing defects and faulty workmanship under normal use conditions
  • Warranty excludes damage from misuse, accidents, normal wear and tear, or acts of nature

8.2 Warranty Claims

  • All warranty claims must be reported in writing within 30 days of discovery
  • We reserve the right to inspect and assess all warranty claims
  • Warranty remedies are limited to repair or replacement at our discretion
  • Warranty does not cover consequential damages or losses

9. LIMITATIONS OF LIABILITY

9.1 Liability Limits

  • Our liability is limited to the value of the specific products or services provided
  • We exclude liability for consequential, indirect, or special damages
  • We do not accept liability for delays in delivery or installation
  • Customer assumes responsibility for compliance with building codes and regulations

9.2 Force Majeure

  • We are not liable for delays or failures due to acts of God, government actions, strikes, material shortages, or other circumstances beyond our reasonable control

10. INTELLECTUAL PROPERTY

  • All designs, drawings, and specifications remain the property of Express Windows and Doors
  • Customers may not reproduce or distribute our proprietary designs without written consent
  • Alspec Carinya trademarks and designs remain the property of Alspec

11. PRIVACY AND DATA PROTECTION

11.1 Personal Information

  • We collect and use personal information in accordance with our Privacy Policy
  • Customer information is used for order processing, delivery, installation, and warranty purposes
  • We may share necessary information with suppliers, contractors, and delivery services

12. RETURNS AND CANCELLATIONS

12.1 Custom Products

  • All products are custom-manufactured and generally non-returnable
  • Orders may be cancelled before manufacturing commences, subject to a cancellation fee
  • Cancellation after manufacturing commencement will result in full payment requirement

12.2 Defective Products

  • Genuinely defective products will be repaired or replaced at no cost to customer
  • Assessment qualified technicians will conduct assessment of defects

13. HEALTH AND SAFETY

13.1 Delivery Safety

  • Customer must ensure safe working environment during delivery
  • All relevant safety regulations and building codes must be complied with
  • Customer must inform us of any site hazards or special safety requirements

13.2 Product Safety

  • Products must be installed and used in accordance with manufacturer specifications
  • Safety glass and relevant safety features are included where required by Australian Standards

14. BUILDING CODES AND COMPLIANCE

14.1 Regulatory Compliance

  • Customer is responsible for obtaining necessary permits and approvals
  • Products are designed to meet relevant Australian Standards where applicable
  • Customer must ensure installation complies with local building codes
  • We provide technical specifications to assist with compliance requirements

15. DISPUTE RESOLUTION

15.1 Resolution Process

  • Any disputes should first be raised directly with our management team
  • We are committed to fair and prompt resolution of all legitimate concerns
  • Disputes may be referred to relevant industry bodies or mediation services
